Serena Care tıbbi cihaz değildir ve SOS butonu 112'yi aramaz. Hatırlatıcıların gelmesi garanti edilemez. Bu şartların ayrılmaz parçası olan tüm sınırlamalar için Sorumluluk Reddi sayfasını okumanız zorunludur.
1. Taraflar ve kabul
Bu şartlar, Serena Care mobil uygulamasını ("Uygulama") sunan RuiCodex ile Uygulamayı kullanan siz ("Kullanıcı") arasındaki sözleşmedir. Uygulamayı indirerek, hesap oluşturarak veya kullanarak bu şartları ve Gizlilik Politikası ile Sorumluluk Reddi belgelerini kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kullanmayın.
2. Hizmetin tanımı
Serena Care; yaşlı bireylerin ilaç saatlerini, doktor randevularını ve ruh hâlini kaydetmeye ve bu bilgileri kullanıcının onayladığı bakıcı ve aile üyeleriyle paylaşmaya yarayan bir takip ve organizasyon aracıdır. Tıbbi hizmet, tanı, tedavi, acil yardım veya bakım hizmeti sunmaz.
3. Hesap ve roller
- Uygulamayı kullanmak için 18 yaşını doldurmuş olmanız gerekir.
- Üç rol vardır: Yaşlı (hasta), Aile Üyesi ve Bakıcı.
- Bakıcı–hasta ve aile–hasta bağlantıları referans kodu ve karşılıklı onay ile kurulur. Onaylamadığınız hiç kimse verilerinizi göremez.
- PIN kodunuzun gizliliğinden siz sorumlusunuz. Hesabınızda yapılan işlemler size atfedilir.
- Verdiğiniz bilgilerin doğru ve güncel olmasından siz sorumlusunuz.
- Bir başkasının sağlık verisini giriyorsanız, bunun için yetkili olduğunuzu ve ilgili kişinin açık rızasını aldığınızı beyan edersiniz.
4. Abonelik, ödeme ve iptal
- Uygulamanın temel özellikleri ücretsizdir. Ücretsiz plan 3 ilaç ve 1 hasta ile sınırlıdır.
- Serena Premium aylık veya yıllık abonelik olarak sunulur ve bu sınırları kaldırır.
- Tüm ödemeler Google Play Faturalandırma üzerinden yapılır. RuiCodex kart bilgilerinizi görmez ve saklamaz.
- Abonelikler iptal edilene kadar otomatik olarak yenilenir. Yenileme, dönem bitiminden 24 saat önce hesabınızdan tahsil edilir.
- İptal: Google Play > Abonelikler bölümünden dilediğiniz zaman. İptal, mevcut dönemin sonunda geçerli olur; kalan süre boyunca Premium erişiminiz sürer.
- İade talepleri Google Play politikalarına tabidir ve Google üzerinden yapılır. Tüketici mevzuatından doğan cayma haklarınız saklıdır.
- Fiyatlar bölgeye göre değişir ve Uygulama içinde Google Play'den alınan güncel fiyat gösterilir. Fiyat değişikliği önceden bildirilir.
5. Kabul edilebilir kullanım
Şunları yapamazsınız: Uygulamayı hukuka aykırı amaçlarla kullanmak; başkasının hesabına izinsiz erişmek; sisteme aşırı yük bindirmek veya güvenlik önlemlerini aşmaya çalışmak; Uygulamayı tersine mühendislikle çözmek, kopyalamak veya türev çalışma üretmek; başkasının sağlık verisini rızası olmadan girmek.
6. Fikri mülkiyet
Uygulamanın yazılımı, tasarımı, markası ve içeriği RuiCodex'e aittir. Size yalnızca kişisel ve devredilemez bir kullanım lisansı verilir. Girdiğiniz veriler size aittir.
7. Hizmetin sürekliliği
Uygulamanın kesintisiz veya hatasız çalışacağını taahhüt etmiyoruz. Bakım, güncelleme, teknik arıza veya hizmetin sonlandırılması nedeniyle erişim kesilebilir. Hizmeti sonlandırmamız hâlinde makul bir süre önce bildirim yapar ve verilerinizi dışa aktarmanız için imkân sağlarız.
8. Garanti reddi ve sorumluluğun sınırlandırılması
Uygulama "OLDUĞU GİBİ" sunulur; belirli bir amaca uygunluk dâhil açık veya zımni hiçbir garanti verilmez. Sorumluluk Reddi belgesindeki sınırlamalar bu sözleşmenin ayrılmaz parçasıdır.
Yürürlükteki hukukun izin verdiği azami ölçüde RuiCodex'in toplam sorumluluğu, talebin doğduğu tarihten önceki 12 ay içinde Uygulama için ödediğiniz tutarla sınırlıdır. RuiCodex; kaçırılan ilaç dozları, ulaşmayan SOS bildirimleri, gösterilmeyen hatırlatıcılar veya veri kaybından doğan dolaylı ve sonuç niteliğindeki zararlardan sorumlu değildir.
Bu sınırlamalar; kasıt, ağır ihmal, ölüm veya bedensel zarar hâllerinde ve tüketicinin mevzuattan doğan, sözleşmeyle sınırlanamayan haklarını etkilemez.
9. Fesih
Hesabınızı dilediğiniz zaman silebilirsiniz (bkz. Hesap Silme). Bu şartların esaslı ihlali hâlinde hesabınızı askıya alabilir veya kapatabiliriz.
10. Uygulanacak hukuk
Bu sözleşme Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İstanbul mahkemeleri ve icra daireleri yetkilidir. Tüketici sıfatıyla, yerleşim yerinizdeki tüketici hakem heyetine veya tüketici mahkemesine başvurma hakkınız saklıdır; AB'de ikamet ediyorsanız kendi ülkenizin zorunlu tüketici koruma hükümleri geçerliliğini korur.
11. Değişiklikler
Bu şartlar güncellenebilir. Esaslı değişikliklerde Uygulama içinde bilgilendirme yapılır; değişiklik sonrası kullanım kabul anlamına gelir.

1. Parties and acceptance
These Terms form the agreement between RuiCodex, provider of the Serena Care mobile application (the "App"), and you (the "User"). By downloading, creating an account or using the App you accept these Terms, the Privacy Policy and the Disclaimer. If you do not accept them, do not use the App.
2. Description of the service
Serena Care is a tracking and organisation tool that records medication times, medical appointments and mood for older adults, and shares that information with caregivers and family members the user has approved. It does not provide medical services, diagnosis, treatment, emergency assistance or care services.
3. Account and roles
- You must be 18 or older to use the App.
- There are three roles: Elderly (patient), Family Member and Caregiver.
- Caregiver–patient and family–patient links are created via a reference code and mutual approval. Nobody you have not approved can see your data.
- You are responsible for keeping your PIN confidential. Actions taken on your account are attributed to you.
- You are responsible for the accuracy of the information you enter.
- If you enter another person's health data, you confirm that you are authorised to do so and have that person's explicit consent.
4. Subscription, payment and cancellation
- Core features are free. The free plan is limited to 3 medications and 1 patient.
- Serena Premium is offered as a monthly or yearly subscription and removes these limits.
- All payments are processed through Google Play Billing. RuiCodex never sees or stores your card details.
- Subscriptions renew automatically until cancelled. Renewal is charged within 24 hours before the end of the current period.
- To cancel: Google Play > Subscriptions, at any time. Cancellation takes effect at the end of the current period; Premium access continues until then.
- Refunds are governed by Google Play policies and handled by Google. Statutory withdrawal rights under consumer law are unaffected.
- Prices vary by region; the App always shows the current price retrieved from Google Play. Price changes are notified in advance.
5. Acceptable use
You may not: use the App for unlawful purposes; access another person's account without permission; overload the service or attempt to circumvent security measures; reverse-engineer, copy or create derivative works of the App; or enter another person's health data without their consent.
6. Intellectual property
The App's software, design, brand and content belong to RuiCodex. You are granted only a personal, non-transferable licence to use. Data you enter remains yours.
7. Availability
We do not warrant that the App will operate uninterrupted or error-free. Access may be interrupted by maintenance, updates, technical faults or discontinuation of the service. If we discontinue the service, we will give reasonable prior notice and an opportunity to export your data.
8. Disclaimer of warranties and limitation of liability
The App is provided "AS IS", without warranties of any kind, express or implied, including fitness for a particular purpose. The limitations in the Disclaimer form an integral part of this agreement.
To the maximum extent permitted by applicable law, RuiCodex's total liability is limited to the amount you paid for the App in the 12 months preceding the claim. RuiCodex is not liable for indirect or consequential damages arising from missed medication doses, undelivered SOS alerts, reminders that were not shown, or data loss.
These limitations do not apply in cases of wilful misconduct, gross negligence, death or personal injury, and do not affect a consumer's statutory rights that cannot be limited by contract.
9. Termination
You may delete your account at any time (see Account Deletion). We may suspend or close your account in the event of a material breach of these Terms.
10. Governing law
This agreement is governed by the laws of the Republic of Türkiye, with the courts of Istanbul having jurisdiction. As a consumer you retain the right to apply to the consumer arbitration committee or consumer court at your place of residence; if you reside in the EU, the mandatory consumer protection rules of your country continue to apply.
11. Changes
These Terms may be updated. Material changes will be announced in the App; continued use after a change constitutes acceptance.
